1. Introduction

The Digital Millennium Copyright Act (DMCA) was enacted in 1998 to address the challenges posed by the internet to copyright law. This legislation provides a framework for copyright owners to protect their works online while also establishing safe harbor provisions for online service providers. The purpose of this DMCA policy is to outline the procedures for reporting copyright infringement on The Service, as well as the rights and responsibilities of all parties involved.

If you believe that your copyrighted work has been infringed upon by content available on The Platform, you may submit a notification to our designated copyright agent. Your notification must include the following information: a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; identification of the copyrighted work claimed to have been infringed; identification of the material that is claimed to be infringing, along with sufficient information to locate the material on The Service; your contact information, including your address, telephone number, and email address; a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law; and a statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

3. Counter-Notification

If you believe that your material has been removed by mistake or misidentification, you may submit a counter-notification to our designated copyright agent. Your counter-notification must include: your physical or electronic signature; identification of the material that has been removed and the location where it appeared before removal; a statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification; and your contact information, including your address, telephone number, and email address. Upon receipt of a valid counter-notification, we may restore the removed material within 10 to 14 business days unless the copyright owner files an action seeking a court order against you.

4. Safe Harbor Provisions

The DMCA provides safe harbor provisions that protect online service providers from liability for copyright infringement committed by their users, provided that the service providers comply with certain requirements. To qualify for safe harbor, The Platform must not have actual knowledge of infringing material, must not be aware of facts or circumstances that would make infringing activity apparent, and must act expeditiously to remove or disable access to infringing material upon receiving proper notification. This means that The Service is not liable for user-generated content unless it fails to act upon receiving a valid DMCA notice.

5. User Responsibilities

Users of The Service are responsible for ensuring that their content does not infringe upon the copyrights or other intellectual property rights of third parties. By submitting content to The Platform, users represent and warrant that they have the necessary rights to use and distribute such content and that it does not violate any applicable laws or regulations. Users are encouraged to seek legal advice if they are unsure about the copyright implications of their content.

6. Repeat Infringer Policy

In accordance with the DMCA, The Service has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. A repeat infringer is defined as a user who has been the subject of multiple valid DMCA notifications. The Service reserves the right to determine, in its sole discretion, whether to terminate a user's account based on the frequency of copyright infringement.

7. Disclaimer of Warranties

The Service is provided on an 'as-is' and 'as-available' basis. We make no representations or warranties of any kind, express or implied, regarding the operation of The Platform or the information, content, materials, or products included on The Service. To the fullest extent permissible by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. We do not warrant that The Service will be uninterrupted, secure, or free of errors or viruses.

8. Limitation of Liability

In no event shall The Service, its affiliates, or their respective officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of The Platform, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, even if advised of the possibility of such damages. The total liability of The Service for any claims arising out of or relating to this DMCA policy shall not exceed the amount paid by the user, if any, for accessing The Service.

9. Governing Law

This DMCA policy shall be governed by and construed in accordance with the laws of the jurisdiction in which The Service operates, without regard to its conflict of law principles. Any disputes arising out of or relating to this policy shall be resolved in the competent courts of that jurisdiction.

10. Changes to This Policy

The Service reserves the right to modify this DMCA policy at any time. Any changes will be effective immediately upon posting the revised policy on The Platform. Users are encouraged to review this policy periodically to stay informed about our copyright practices. Continued use of The Service after any changes to this policy constitutes acceptance of the revised terms.
